Defendant shall be punished by a fine of five million won.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. The defendant of "2018 Highest 7001" is an employer who runs an environmental device manufacturing business using 30 full-time employees, who are the representative director of F (ju) in Gyeonggi E in terms of economic harmony;

When a worker retires, the employer shall pay the wages, compensations, retirement allowances, and other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That the date of payment may be extended by the agreement between the parties if special circumstances exist.

Nevertheless, the Defendant is working from June 1, 2011 to May 31, 2018 at the above workplace.

In May 2018, G 62,592,194 won in total, including three workers' wages, retirement allowances, etc., including 5,408,30 won in arrears, was not paid within 14 days from the date of each retirement without an agreement on extension of the due date between the parties concerned, as stated in attached Forms 1 through 3, as well as 5,408,30 won in arrears.

2. The Defendant of Geumcheon-gu Seoul Metropolitan Government is the representative of the FF Seoul Business Office in Geumcheon-gu, who runs an environmental device manufacturing business using 18 full-time workers.

When a worker dies or retires, an employer shall pay the wages, compensations, retirement allowances, and all other money and valuables within 14 days after the cause for such payment occurred.

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant is working in the above workplace from April 8, 2013 to June 30, 2018.
