A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant is the representative of C Co., Ltd. in the third floor of the building B in Si interest-si, who runs the manufacturing of industrial valves by using ten full-time workers.

When a worker retires, the employer shall pay the wages, compensations, and other money and other valuables, and retirement allowances within fourteen days after the cause for such payment occurred.

The defendant is the representative director of the C Co., Ltd. in the building No. B of Silung-si, who runs the business of manufacturing industrial valves by using four full-time workers.

1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the defendant is working from October 1, 2019 to March 31, 2020 at the above workplace.

The retired FF's wages of 2,600,000 won on February 1, 2020, wages of 2,600,000 won on March 3, 2020, bonuses of 1,300,000, total amount of KRW 6,500,000, and labor from January 1, 2018 to March 31, 2020.

The total amount of wages of G retired 270,570 won on June 2019, wage of 745,730 won on July 7, 2019, wage of 445,730 won on January 2020, wage of 4,200,000 won on February 2020, wage of 4,200, wage of 4,200,000 won on March 3, 2020, wage of 149,090 won on year-end settlement refund of 2018, and the annual refund of 296,520 won on year-end settlement of 2019, total of 14,061,910 won.
