[Defendant A] The defendant shall be punished by imprisonment with prison labor for one year and by a fine of 10,00,000 won.
The above fine shall not be paid by the defendant.
Reasons
Punishment of the crime
Defendant A of the 2015 Highest 7967, who sells construction materials, etc. manufactured in China to Russia, operated C and B, and Defendant C and Defendant B are corporations established for the purpose of selling construction materials, etc. respectively.
No one may export or sell goods, etc. produced in a foreign country under the pretending that they are Korea by forging or altering a certificate of origin, obtaining a certificate of origin with false content, or falsely indicating the origin on goods, etc., as if they were Korea.
1. Defendant A
A. A total of 462 U.S. dollars 34,888,686 ($38,436,402,954) exported used domestic construction materials and piping materials to Russia, and the country of origin of the goods produced in a foreign country pretended that the country of origin of the goods produced in the foreign country is the Republic of Korea.
B. On August 7, 2013, the Defendant exported Chinese plastic pipes to Russia at the above Busan Customs Office, and exported them as if the origin of goods, etc. produced in a foreign country by means of display, etc. in J is the Republic of Korea, and as between July 10, 2014 and July 10, 2014, the list of crimes committed in annexed hereto.
