Punishment of the crime

Defendant

A is the representative director of corporation B, and the defendant corporation B is a corporation established for the purpose of manufacturing and selling medical devices such as blood dypology measuring devices.

1. Defendant A

A. A person who violates the Foreign Trade Act from June 3, 2014 to January 15, 2019 shall not export goods, etc. by pretending that the origin of goods produced in a foreign country is Korea by obtaining a false certificate of origin or by falsely indicating the origin on goods, etc.

Nevertheless, the Defendant, by attaching a false indication of origin to Korea on the blood measuring instruments, etc. produced and imported from China, had the place of origin of the above used domestic goods so as to be exported as if they were Korea.

Accordingly, around June 3, 2014, the Defendant, at the company of the Defendant in Seongbuk-gu, Seongbuk-gu, Sungnam-gu, issued a label equivalent to KRW 60,796, which was manufactured and imported from China in China, to pack it to the Incheon Customs Office with an “Made in Korea,” and then exported it by reporting it to Korea. From around that time to January 15, 2019, the Defendant exported the country of origin as seen above in the following manner: (a) during a total of 152 times, including the list of crimes in attached Form 152, the total market price of KRW 12,298,706,986, China-gu.

(b) No person who violates the Foreign Trade Act on February 19, 2019 shall export goods, etc. by pretending that the country of origin of goods produced in a foreign country is Korea by obtaining a false certificate of origin or by falsely indicating the country of origin on goods, etc.

Nevertheless, the Defendant, by attaching a false indication of origin to the blood-related measuring instruments, etc. produced and imported in China, is as if the origin of the above domestic goods is Korea.
