A defendant shall be punished by imprisonment for one year.

Seized evidence1 to 20 shall be confiscated from the accused.

Punishment of the crime

On October 2016, the Defendant, as a foreigner of Malaysia’s nationality, received a proposal that “The Defendant left the Republic of Korea with a credit card in four names with a false credit card, so that it can be forged and falsified, and the card will not be settled. If a credit card is settled, it will be given in consideration of 10% of the amount of the good.”

The Defendant, in response to this, was informed of the name and date of birth of the Defendant to the influence winners, and was issued a total of 20 credit cards forged in such a way as to enter the Defendant’s name on the card with a Mabio-Ba card (D) copied with the information of the modern visa (D) issued by C from the influence winners, including one forged modern visa card, and the Korea Civil Aviation KE671.

The Defendant left the Republic of Korea using the above flight tag to Japan, but was unable to purchase the name cards in Japan because the said cards were not settled, and was willing to purchase the goods at the Incheon Airport duty-free shop, which is the destination of the route.

Accordingly, at around 14:47 on October 23, 2016, the Defendant: (a) purchased two rooms and two labels for male use by the victim company in Jung-gu Incheon, Jung-gu, Incheon; and (b) presented a forged modern visa (credit card number D) to G as if the credit card was actually issued; (c) received goods equivalent to KRW 5,65,000 at the market price from the victim company’s store; (d) continuously purchased three bags of the victim company at the victim company’s store at around 15:06 on the same day; and (e) presented them to G as if the falsified card (credit card number I) was actually issued, and received goods equivalent to KRW 5,515,00 at the market price from the victim.
