Reasons
Punishment of the crime
1. The Defendants jointly committed the crime of Defendant A and Defendant C prepared a false lease agreement and offered it as security to the victim G and offered money to have them shared by borrowing money from the victim.
A. On June 23, 2010, the Defendants conspired to forge private documents 1) at a place where the location cannot be known on June 22, 2010, Defendant C, using the pen in the pre-owned real estate lease contract form, entered the lessor’s address column “Seoul H building 905” and “I” in the name column, and affixed an I’s seal arbitrarily created by the Defendants.
As a result, the Defendants forged one chapter of the real estate lease agreement in the name of the private document concerning rights and obligations for the purpose of exercising the rights and obligations in collusion.
2) On June 23, 2010, the Defendants conspired with the Defendants to hold the said investigation document and exercised the forged real estate lease agreement as if it were a document duly formed, in that of coffee located in Yongsan-gu Seoul Metropolitan Government K on June 23, 2010.
3) The fraud Defendants conspired to offer forged real estate lease contract as security as described in the foregoing paragraph 2) at the time, place, and Defendant A received 6.5 million won from the injured party to the account under the name of Defendant A, and 2 million won from July 28, 2010, respectively, under the same name as stated in the foregoing paragraph, and acquired 9.5 million won in cash by receiving 1 million won from the injured party on July 28, 2010.
B. On July 8, 2010, the Defendants conspired to forge private documents 1) at a place where it is impossible to know the location on July 6, 2010, the Defendants conspired to forge private documents, and at a place where it is impossible to know the location on July 6, 2010, and at the address column of the location of the lessor of the site of the real estate lease contract previously possessed by a person who is unaware of the name.
