Reasons
Punishment of the crime
[Defendant B] The Seoul Southern District Court sentenced 6 months of imprisonment with prison labor for fraud and 2 years of suspended execution on October 25, 2014 at the Seoul Southern District Court on October 17, 2014 and became final and conclusive on October 25, 2014.
【Criminal facts】 Defendant A and Defendant B were simple married, but they are currently divorced, and Defendant C are the creditors of Defendant A.
Defendant
A had been liable to Defendant C for 48 million won but failed to make a change, the Defendant A agreed to obtain a loan in the name of F, his/her father, and repaid the loan. However, the Defendant Company A offered an officetel as security at the time of the above loan, but it is difficult to obtain a loan due to a lease agreement of KRW 150 million in the above officetel. The Defendants forged a lease agreement with the content of KRW 5 million in deposit and KRW 800,000 in monthly rent, and conspired to obtain a loan by submitting a forged lease agreement with the NA.
1. Forgery of private documents and the uttering of a falsified investigation document;
A. (1) On January 2013, the Defendants conspired to forge the lease contract and set up a lease contract forgery and event (1) in collusion with the Defendant’s operation on the first floor of Guro-gu Seoul Metropolitan Government G, and the first floor of the building, Defendant B forged one copy of the lease contract, which is a private document on the rights and obligations of the said J, with the aim of exercising the said J’s seal affixed to the lessor’s name and affixed to the lessor’s name.
