The prosecutor's appeal is dismissed.

1. The gist of the grounds for appeal was that the Defendant testified against memory even though he paid money under the pretext of protection expenses to prevent D from being satising a failure at the business establishment.

2. The judgment of the court below is just in light of the reasoning and the evidence submitted by the prosecutor alone is insufficient to acknowledge this part of the facts charged, and there is no other evidence to prove otherwise, and the judgment of the court below is just in comparison with the records. Thus, the prosecutor's assertion is without merit.

3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
