The prosecutor's appeal is dismissed.

1. The Defendant appeared as a witness of the Seoul Northern District Court case 2012 Godan2130, and was notified of the right to refuse to testify and made a false statement contrary to his memory.

2. The court below stated the reasons in detail, and found the defendant not guilty on the grounds that the evidence submitted by the prosecutor alone is insufficient to recognize the facts charged, and there is no other evidence to prove otherwise. The judgment of the court below is just and acceptable, and the prosecutor's assertion is without merit.

3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
