A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. No person who violates the Act on the Punishment, etc. of Acts, including brokerage, etc. of sexual traffic, shall engage in any similar sexual intercourse using any part of the body, such as sexual intercourse, mouth or anus, or implements, or mediate, solicit, induce, or compel an unspecified person to become the other party to such conduct;
Nevertheless, around January 1, 2016, the Defendant entered into a sublease contract with D and D deposit amounting to KRW 20 million, monthly rent of KRW 5810,000,000 from D, on the condition that the Defendant would pay KRW 5810,000,000, and, from January 1, 2016 to April 6, 2017, the Defendant assisted sexual traffic women, such as E, from the said “C User” to the said “C User,” to the said “specific male customers, who had found the said business place, to receive KRW 70,00 or KRW 80,00 from the unspecified male customers, as the price for sexual traffic, thereby leading them to sexual intercourse.
2. No person who violates the Act on the Punishment, etc. of Acts, including brokerage, etc. of sexual traffic, shall engage in similar sexual intercourse with an unspecified person using, or become the other party to, sexual intercourse using, part of the body, such as sexual intercourse, mouth or anus, in return for receiving or promising to receive money, valuables or other property benefits from such unspecified person;
Nevertheless, from April 5, 2017 to the around the 6th of the same month, the Defendant received 70,000 won from the personal male grandchildren who found the business place from the above “C User” and received 70,000 won as the price for sexual intercourse.
3. A marina in violation of the Medical Service Act shall obtain qualification recognition from the Mayor/Do Governor from among persons with visual disabilities under the Welfare of Persons with Disabilities Act, who have completed relevant education courses, etc., and shall not engage in massage for profit without obtaining qualification recognition from the Mayor/Do Governor;
Nevertheless, the defendant is deceased on April 6, 2017 without qualification of massage.
