A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Criminal facts

피고인은 C, 전화 금융 사기( 이하 ‘ 보이스 피 싱’ 이라 함) 일당인 성명을 알 수 없는 사람( 위 챗 메신저 닉네임 ‘D’, 이하 ‘ 닉네임 D’ 이라 함) 과 같이, 닉네임 D이 피해자들에게 전화를 걸어 ‘ 기존 대출금 일부를 변제하면 신규 대출을 해 주겠다.

“Falsely speaking, the victims shall transfer money under the name of “Partial Repayment of Loans” to the Agricultural Cooperative Account (F) in the name of E, and shall make phone calls to E, and shall continue to make a loan by means of remitting money to the head of the Tong, and deliver the money deposited in the head of the Tong to a specific place by withdrawing in cash and delivering it to the designated person of the Republic of Korea at a specific place.” The delivery of the Bosing Organization of the Bosing Organization was made at the said place by receiving cash withdrawn from the said account (the money remitted by the victims) from E at the said place, and C and the Defendant conspiredd to commit a Bosing crime in the Republic of Korea to invite a person to deliver the money deposited in the said account (the delivery note).

C은 2017. 6. 27. 경 불상의 장소에서 G에게 QQ 메신저로 연락하여 “ 위 챗 (WeChat) 메신저 닉네임 ‘D’ 이라는 사람이 연락하여 시키는 대로 하면 100만 원을 수고비로 주겠다.

”라고 지시하고, 이에 G은 H에게 위와 같은 지시를 전달하고, 닉네임 D은 H에게 위 챗 메신저로 연락하여 ‘ 울산에서 사람을 만 나 돈을 건네받은 후 서울 대림 역에 있는 환 전소로 가서 돈을 전달하라’ 고 지시하였다....
