Defendant
A A shall be punished by a fine of two million won, and Defendant B shall be punished by a fine of four hundred thousand won.
The above fines are imposed by the Defendants.
Reasons
Punishment of the crime
No person shall capture or gather marine animals and plants in any manner other than those prescribed by the law of fisheries.
1. Defendant A and B, while knowing that he was living in large quantities in the seabed near the breakwater scoo-dong, at the same time, knew of the fact that he was living in large quantities, Defendant A and the Defendants were trying to illegally capture it as scoods diving. On August 1, 2015, Defendant A, around August 21, 2015, loaded a non-registered leisure vessel with various diving equipment, such as diving clothes and air tank, entered the port, and operated the said vessel at the sea near the ship located in the scoodong-dong at the scoo-dong at the scoodong at the time of scook-dong, and Defendant B illegally captured approximately 40 kmg (marketing 80,000 won) and illegally captured the said vessel in a way other than the fishery provided for in the Fisheries Act.
2. Defendant A knew with D (Death on August 18, 2016), that he was living in large quantities in the seabed near the breakwater scoober, with the intent to illegally capture it as a scood, and around 21:00 on June 15, 2016, Defendant A loaded various diving equipment, such as diving and air tank, onto the unregistered leisure vessel and departed from the port, and operated the said vessel at the sea near the scood Mapo-dong Gapo-dong Gapo-dong, with the equipment of diving and wearing diving equipment, and obtained D illegally capture approximately 40 km (market price of KRW 80,000) in nature, living on the seabed, together with the list of crimes in attached Form D, by means other than the Fisheries Act from August 13, 2016 to August 13, 2016.
