Reasons
Punishment of the crime
The Defendants, using the scoo equipment, take a key to the seabed and divide profits therefrom. Defendant A, who is willing to operate a motor boat C (2.44 tons, 225 EM, registration number D) and Defendant B, on board the above C and obtained a key to the seabed using the scoo equipment.
1. No one shall capture or gather marine animals and plants in any manner other than the fishery business under the Fisheries Act or the Fishery Resources Management Act;
Nevertheless, from around 09:30 on September 12, 2014 to around 19:30 on the same day, the Defendants: (a) from the coast guard located in Chungcheongnam-gun, Chungcheongnam-gun; (b) at the coast guard, Defendant A boarded the above Defendant B to the above Defendant C, and navigated it to the neighboring sea of the U.S. located in the same Gun; and (c) Defendant B was equipped with scoo equipment, such as air flow, diving clothes, water breath, water breath, water breath, air breath, air fluor, and air breath, and acquired underwater water.
Defendant B continued to gather a key string that forms the seabed and put it into the collection network, and Defendant A continued to collect approximately 400 natural kids in a way of inserting the kidsing net on one network by advertising 40 kids and inserting it into the line with a view to controlling guard.

Defendant A, from around 09:30 on September 12, 2014 to around 19:30 on the same day, operated a motor boat without obtaining an operator license at the place specified in paragraph (1) and without obtaining an operator license, and from the above date to the 18th day of the same month, Defendant A operated the motor boat without obtaining an operator license more than three times in total, as shown in attached Table 2, from the above date to the above day.
