A Imprisonment of 10 months, Defendant B’s imprisonment of 8 months, Defendant C’s imprisonment of 4 months, and Defendant D’s fine of 15 million won.

Punishment of the crime

Defendant

A is the owner and captain of a non-registered fishing vessel (as approximately 2.98 tons), and Defendant B and C are the persons who work for the diving of the aforementioned unregistered fishing vessel, Defendant D is a seafarer who assists the diving division in the work, and Defendant E is a fishery products distributor who operates “G” located in the military city of Busan.

1. Violation of Acts concerning fisheries;

(a) No person shall capture, gather or cultivate marine animals and plants by any fishing method other than those under the law of fisheries or the management of fishery resources;

Nevertheless, from around 18:40 on March 28, 2018 to around 0:58 of the same month, the above Defendants: (a) operated the above unregistered fishing vessel at the sea around HL in Gunsan-si; (b) arranged the catch taken by Defendant B from the unregistered fishing vessel to the port of the sea; and (c) collected approximately KRW 13,700,750 g of the market price in total at three times, including from the time of collecting approximately 325 g of the sea, from April 6, 2018 to April 6, 2018.

As a result, the above Defendants conspired to gather marine animals and plants in a manner other than fishing under the Fishery-Related Acts and subordinate statutes.

B. From April 18, 2018 to April 20:25, 2018, Defendants A, B, C, and D, on the sea around H breakwater in Gunsan-si, from around 19:28 to around 19:28 of the same month, the role of Defendant A, while operating the above unregistered fishing vessel; Defendant B and Defendant C, by wearing diving equipment, such as air transit, and by obtaining them from the sea, take the role of gathering sea ginseng from the sea to the bottom of the said vessel; Defendant D would draw the sea wave taken by Defendant B and C.
