A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On August 26, 2015, the Defendant was sentenced to a fine of KRW 3 million for a violation of the Road Traffic Act (drinking driving), and on November 25, 2016, the same court issued a summary order of KRW 5 million for a violation of the Road Traffic Act (drinking driving), and on January 24, 2017, the same court was sentenced to a fine of KRW 6 million for a violation of the Road Traffic Act (drinking driving).

[Criminal facts]

1. On April 15, 2017, the Defendant violated the Road Traffic Act (unlicensed Driving) on or around April 15, 2017, driving a Dexton car from the road front of the Defendant’s residence in the Gyeongbuk-gun apartment apartment in the Gyeongbuk-gun apartment in the Gyeongbuk-gun, Chungcheongnam-dong, Chungcheongnam-dong, Chungcheongnam-dong, Chungcheongnam-dong, to the Defendant’s residence.

2. On May 4, 2017, the Defendant violated the Road Traffic Act (unlicensed Driving) on or around May 4, 2017, operated a Dexton car from the road in front of the Defendant’s residence in the Gyeongdong-dong apartment apartment of the Gyeongbuk-gun, Chungcheongnam-si, Chungcheongnam-dong, Chungcheongnam-dong, Gyeongdong-dong, to the Defendant’s residence, through approximately 204km away from the road in front of the Defendant’s residence, without a driver’s license.

3. On June 23, 2017, the Defendant violated the Road Traffic Act (unlicensed Driving) on or around June 23, 2017, driving a Dexton car from the road front of the Defendant’s residence in the Gyeongbuk-gun apartment apartment in the Gyeongbuk-gun apartment in the Gyeongbuk-gun, Chungcheongnam-dong, Chungcheongnam-dong, Chungcheongnam-dong, Chungcheongnam-dong, to the Defendant’s residence.

4. The crime committed on September 17, 2017;

A. On September 17, 2017, the Defendant violated the Road Traffic Act and the Road Traffic Act (driving without a license), without obtaining a driver’s license in the section of about 1km from the front of the apartment apartment of the Gyeongdong-gun, Gyeongbuk-do, to the end of the short frame in front of the same military, from around 1km to the road in front of the short frame in the same military, and driving a Dsch-ton car with alcohol concentration of 0.094% while under the influence of alcohol during blood.

In this respect, the Defendant was drunk.
