A Imprisonment with prison labor for a period of two years and six months, and for a period of two years, respectively.
However, for the period of three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On August 17, 2016, the Defendants were married couple, who were sentenced to the suspension of the execution of six months of imprisonment with prison labor at the Busan District Court on August 25, 2016, and each of them became final and conclusive on August 25, 2016.
In 2013, the Defendants, while operating a main store in the Seosan-dong in Busan Metropolitan City, was responsible for the amount of KRW 80 million due to business depression and credit cards, etc., the Defendants were able to obtain money from the victims by means of false statement, etc. with the lessor’s consent, with a view to repaying the above debt or preparing living expenses, after concluding a monthly lease contract with the low-amount of rent deposit, and after obtaining the lessor’s consent under the lease contract with the intent of making the lease contract.
1. Crimes related to victims D;
A. On March 10, 2015, the Defendants entered into a monthly rent contract with the owner F to lease KRW 5 million, monthly rent of KRW 5 million, and KRW 500,000,000 from the owner F with respect to the building E (703), and posted an advertisement to the effect that they will hold office on the Internet car page at that city.
