Defendants shall be punished by imprisonment for six months.
However, the Defendants are above two years from the date when this judgment became final and conclusive.
Reasons
Punishment of the crime
The Defendants: (a) from around 2013 to around 400, the Plaintiff was operating the main points in the Busan So-gu, Busan; (b) from around 2013 to due to business depression and credit cards; (c) leased a lease deposit and monthly rent of an officetel in the Busan City to make a change; (d) subsequently, the Defendants conspired to acquire the leased deposit by receiving the sub-lease deposit from the victim as the full-time lease; and (e) on January 18, 2015, leased the lease deposit of KRW 500,000,000 from the owner F to KRW 190,000,000,000.
1. Defendant B’s sole criminal conduct
A. On February 2015, 2015, the Defendant, at the Defendant’s residence located in G apartment No. 105 1903 Dong-dong 105 Dong-dong 1903, Jungsan-si, Busan, on the location of the real estate lease agreement form in which the Defendant was downloaded by using a computer, entered “Yilcheon-gu, Busan (75,000,000 won)” in the column for the address of the lessor’s address, “I”, “I” in the column for the resident registration number of the lessor, and “F” in the name of the lessor, and printed it out in advance to the name of the F.
F's seal has been stamped.
Accordingly, for the purpose of exercising, the Defendant forged one copy of the lease agreement of real estate in the name of F, a private document on rights and obligations.
B. On March 2015, 2015, the Defendant: (a) on March 2304, 2015, entered a private document in the Seocho-gu, Busan, J building 2304; (b) on the location column of the real estate lease agreement form in which the Defendant was downloaded by using a computer, “M” (140,000,000 won); (c) on the deposit column, “One billion Won (140,000,00 won)”; and (d) on the deposit column, “802 K building in the Southern-gu, Ulsan; (d) on the lessor’s resident registration number column; and (e) printed out “M” in the lessor’s name column; and (e) printed out it in advance to the name of M.
M's seal shall be stamped, and the consent to use the security, and the principal shall be the main owner of Busan Dong-gu J. 2304.
