가. 당사자의 지위 1) 원고는 홍삼, 홍삼제품, 꿀 및 건강기능식품의 제조판매 등을 목적으로 설립된 회사로서, 2013. 1. 30.자로 등록된 특허(특허 제1230121호)인 ‘홍삼이 함유된 마누카 꿀잼’에 관한 특허권자이다. 2) 피고는 인삼제품을 포함한 식품제조 및 판매업 등을 영위하는 회사이다.
