Reasons
1. Basic facts
가. 당사자의 지위 원고는 인삼제품을 포함한 식품제조 및 판매업 등을 영위하는 회사이고, 피고는 홍삼, 홍삼제품, 꿀 및 건강기능식품의 제조판매 등을 목적으로 설립된 회사로서, 2013. 1. 30.자로 등록된 특허(특허 제1230121호)인 ‘홍삼이 함유된 마누카 꿀잼’에 관한 특허권자이다.
B. (1) Around September 2013, the Defendant requested the Plaintiff to produce liquid ginseng products by altering the Defendant’s Mark.
In addition, around September 26, 2013, the Defendant entered into a contract with Nonparty Co., Ltd. (hereinafter referred to as “the instant packaging”) on the content that the rush would produce KRW 90,000,000 as a 5-type plastic automatic packaging machine (hereinafter referred to as “instant packaging machine”).
(2) After having completed the packing machine of this case around the end of November 2013, the packaging machine of this case was established in Chuncheon Factory according to the agreement between the Plaintiff and the Defendant.
(3) On December 1, 2013, the Plaintiff entered into a commodity supply contract with the Defendant (hereinafter “instant contract”). The main contents are as follows.

Article 7 (Methods of Payment of Price) 1 Goods shall be paid in cash from the completion date of delivery to the end of the following month from the issue date of the tax invoice.
