A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above sentence shall be suspended for three years from the date this judgment became final and conclusive.

Punishment of the crime

1. Around May 2, 2017, the Defendant committed a crime, around 07:00 on May 2, 2017, and around 07:0, 2017, the Defendant stolen the victim’s property at the 700,000 won mobile galloning market value of the victim, where the victim’s name at the 700,000 won cannot be known.

2. Crimes committed on May 7, 2017;

A. On May 7, 2017, at around 13:43, the Defendant opened a food entrance and intruded on the structure managed by the victim F, operated by the victim F, in Jung-gu Incheon Metropolitan City, Jung-gu, and opened an entrance to steals money and goods.

B. The Defendant discovered the victim’s own possession at the time and place indicated in Paragraph 2(a), and stolen the cans in the display stand, which brought about a total of KRW 10,00,000 in the market price of six beers.

Around 14:50 on May 7, 2017, the Defendant: (a) concealed the money and valuables in a warehouse in which the victim would have closed down the door; (b) however, the victimized person opened the above warehouse around 18:00 on the same day and discovered the Defendant, and (c) opened the Defendant, the Defendant was able to use a deadly weapon (47cc in total and 35cc in length on a saw-to-day) in the part of the victim, with sound “the saw-to-face (the entire length of 47cc, 124-125cc),” and led the victim to the Defendant’s defense right ex officio, by threatening the victim, and pushing him/her inside the warehouse with the cash amount of KRW 21,00 and KRW 20,000 in tobacco and the market price of KRW 2A,000,000,000 in total. However, according to the evidence duly adopted and examined, this part of the indictment does not affect the Defendant’s defense right to defense ex officio.
