A defendant shall be punished by imprisonment for not less than two years and six months.

Seized evidence 34 and 35 above shall be confiscated.

Punishment of the crime

On September 19, 2008, the Defendant was sentenced to 6 months of imprisonment and 2 million won of fine in a district court for fraud, etc. and confirmed on September 27, 2008, and completed the execution of the sentence in a governmental prison on January 5, 2009.

1. On January 3, 2012, the Defendant, in collaboration with C, posted an advertisement “E” office located in Mapo-gu Seoul Metropolitan Government DD Building 301; the fact, despite that the Defendant did not have the intent or ability to sell the domestic mountain ginseng (cerebral ginseng) in Korea, in operating the above E, the Defendant acquired the low-cost local mountain ginseng from F, etc.; and then acquired the high-cost mountain ginseng in the newspaper advertisement column, such as the Japanese Shipbuilding. In the above office, the Defendant acquired the Chinese mountain ginseng from F, etc., and then acquired the high-cost mountain ginseng in Korea from the victim’s 196,000 through 309,297 through 30,000 won, and the Korean mountain ginseng in charge of packing and delivery in the above office.

2. A person who violates the Act on Origin Labeling of Agricultural and Fishery Products shall not sell, store or display agricultural or fishery products for the purpose of sale under a disguised country of origin, but the Defendant shall jointly do so with C, from January 3, 2012 to March 9, 2012, sell a total of KRW 62,939,000 over 227 times as indicated in the attached Table, in a disguised manner with domestic brain ginseng in the same manner as indicated in paragraph (1).
