A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. On October 21, 2017, around 23:30, the Defendant stolen a mobile phone (opon 7, test color) of KRW 1,050,00 in the market price owned by the victim, which was placed on the front line, with three copies of the No. 1,050,000, which was located on the front line, and three copies of the No. 1,000 in the instant mobile phone case, which were located in the said mobile phone case.
2. Violation of Acts in financial business specializing in fraud and credit finance;
A. On October 22, 2017, at the G convenience store operated by the Victim F in Sinpo City F, on October 22, 2017, the Defendant: (a) purchased one cigarette of KRW 230,500 in total at the market price of KRW 230,500 from an employee in non-name work at the place; (b) purchased one cigarette of KRW 1 A (me non-flus Scarbs), five cigarettes (me non-flus Scarbs), cans (labs) and then issued the NA card as described in paragraph (1) as if the Defendant had a legitimate owner, and had his/her employee settle the price with the said NA card; and (c) acquired the NA card by obtaining one flus and delivery of the cans.
B. On October 22, 2017, the Defendant: (a) at J Mart operated by the victim I located at H around 00:45 on October 22, 2017, the amount equivalent to the total of KRW 228,500 in the market value of which is KRW 500.
When purchasing 1 gamblings and coffees, as described in paragraph (1), stolen C’s agricultural card, as described in paragraph (1), was carried out and issued as if the Defendant was a legitimate holder, and had his/her employees settle the price with the said agricultural card, thereby using the cream card, and acquired the said tobacco 5 mills and coffees by obtaining the said tobacco 1 gambling.
