Defendant shall be punished by imprisonment with prison labor for two months and by imprisonment for eight months for the remaining crimes, respectively.
Reasons
Punishment of the crime
[criminal records] On July 19, 2017, the Defendant was sentenced to six months of imprisonment with prison labor for larceny, etc. at the Busan District Court on February 23, 2018, and was released by the Busan Detention Center on February 23, 2018, and the judgment became final and conclusive on March 3, 2018.

1. At around 12:20 on March 24, 2018, the Defendant: (a) parked the instant cargo vehicle E in front of Busan Dong-gu, Busan; (b) opened a door at which the victim D parked the said cargo vehicle; and (c) cut off the said cargo vehicle in front of the Defendant’s house; and (d) stolen the fright bed by the Defendant at a fly fly flym, the market price of which is equivalent to KRW 75,00,000 in the market price on which the fly fright, driving license, and cash payment note was contained.

Around 12:37 March 24, 2018, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit (hereinafter “FF”) presented the Victim H, the owner of the above convenience store, as if he had completed the stolen CF card, as set forth in paragraph (1), at G convenience stores located in Busan Dong-gu, Busan, to pay KRW 4,500,000 per 1 of the MFS tobacco with the above CF card, and around 12:47 of the same day, the Defendant presented the said CF card to the Victim K, the main owner of the above CFI, as if he had completed the FF card, and had the victim pay KRW 14,50,00,000,000 in the above CF by the above CF card.
Accordingly, the defendant deceiving the victims and acquired a total of KRW 9,000 property interest from the victims twice, and used a stolen credit card.
[2018 Highest 2435] On March 31, 2018, the Defendant: (a) parked a None Star passenger car in front of Busan Dong-gu L, Busan around 09:53, in order to perform a waterproof painting work; and (b) opened a chief door of the said passenger car and opened a white cell with a value equivalent to KRW 500,000,000 at the market price owned by the victim on the front line of the said car and did not correct the locking place between the victims.
