Reasons
Punishment of the crime
1. On August 26, 2013, the Defendant violated the Act on Special Cases Concerning the Settlement of Traffic Accidents, driving the said vehicle at around 23:50, and driving the said vehicle at around 23:50 on August 26, 2013, and driving the two-lane road in front of the Jincheon-gun, Jincheon-gun, Jincheon-gun, Jincheon-gun toward the direction of Jincheon-do and passing through an intersection where traffic is not controlled.
The location was yellow on and off the signal, etc.
In such cases, a person engaged in driving of a motor vehicle shall slowly drive the road where the width of the intersection is wider than that of the road on which the width is wider, and when there is another motor vehicle seeking to enter the intersection from a road with a wide width, he/she has the duty of care to yield the course to prevent accidents in advance.
Nevertheless, the Defendant, as described in paragraph (2) below, is not negligent in performing his duty of care in the state of being drunk and is proceeding as it is.
Defendant
The victim C(52 years of age) driving at a speed on the right side from the right side of the proceeding direction found and operated the D taxi car.
However, there was a conflict between the front part of the vehicle driven by the defendant and the front part of the vehicle driven by the victim.
As a result, the defendant suffered from the victim's negligence such as the NOS and the closed nature of the trend requiring approximately six weeks of treatment.
2. Violation of the Road Traffic Act (driving) driving the vehicles described in paragraph (1) under the influence of alcohol with approximately 0.087% alcohol concentration at a distance of about 10km from the Jincheon-gun, Jincheon-gun, Jincheon-gun, Jincheon-gun, Jincheon-gun to the date and time specified in paragraph (1).
