A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2016 Highest 1967] On February 20, 2016, the Defendant posted a false statement to the effect that “The two shares will be sold” on the NAV Rona Pa, and that “The two shares will be sent at the face of the transfer of KRW 110,000 to the victim C who reported and contacted the above writing.”

However, even if the defendant receives the two payment from the victim, he did not have the intention or ability to sell the two shares.

The Defendant received KRW 110,00 from the victim to the national bank account (D) in the name of the Defendant on the same day.

The Defendant, from that time until March 22, 2016, received a total of 1,650,000 won by deceiving the victims as shown in attached Table 1, as well as attached Table 1.

[2016 Highest 1977] On January 4, 2016, the Defendant stored the victim E’s phone number that he/she came to know in the Kana Kana Kana Kana Kana Kana on the Defendant’s handphone, and subsequently sold the Defendant’s phone number as the Defendant’s Kakao Kakao Kakao Kakao Kakao Kakao Kao Kana that he/she got sold to the Defendant as the Defendant’s crew. The Defendant stated that the Defendant was 60,000 won for two weeks.”

However, the defendant did not have the above two owners at the time, and even if he received the sales proceeds from the victim, he did not have the intention or ability to sell the two owners.

As such, the Defendant, by deceiving the victim as such, received 60,000 won from the victim to the new bank account (number F) in the name of the Defendant on the same day, under the name of both weeks sales proceeds, and received from the victims totaling KRW 1,750,00 from the victims totaling KRW 1,750,000,00 from February 13, 2016 in the same manner as shown in the attached Table 2 of the Crimes List of Crimes.

Accordingly, the defendant deceivings victims to acquire the victims' property.
