1. The Defendant (Counterclaim Plaintiff) shall pay 4 million won to the Plaintiff (Counterclaim Defendant) and its payment from May 16, 2017 to the date of full payment.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Facts of recognition;
A. The Plaintiff is a company that runs a business such as comprehensive travel, discount of airline tickets, marriage agency visa service, etc.
B. 1) On April 20, 2015, the Plaintiff and the Defendant enter into a Vietnam tour agreement (hereinafter “instant tour agreement”) with the following terms and conditions as follows.
A) A contract was concluded, and the Defendant paid 50,000 won to the Plaintiff. - The content of the service was 500,000 won to the Plaintiff. - Provision of opportunity on the premise of marriage with local women in Vietnam - 50,000 won for travel period - 50,000 won for travel period : 50,000 won (including Vietnam aviation fees, accommodation and accommodation) : the Plaintiff entered into the instant side travel contract with the Defendant, and if the Plaintiff wishes to marry with the opposite party, 7,50,000 won (5,000,000 won for a local marriage event, and 2,000,000 won for personal travel and delivery expenses) to be entered into with the Plaintiff, 7,000,000 won for travel and document service expenses (1.5,000,000 won for travel and document agency) between the Plaintiff and the other party, without any intention to marry and any additional expenses.
C. 1) According to the instant adjacent travel contract, the Defendant left Vietnam on May 9, 2015, and introduced the Plaintiff to Vietnam, and the Defendant was a Vietnam female C (hereinafter “C”).
(2) The Defendant returned to the Republic of Korea after completing the instant contact travel contract and demanded the Plaintiff to proceed with the marriage procedure between C and C.
Accordingly, on May 15, 2015, the Plaintiff and the Defendant acting on behalf of the Defendant for the following travel and document agency contracts: (a) the issuance of airline tickets necessary for the departure from Vietnam, or for the reservation of accommodation, and the procedures necessary for reporting marriage in Vietnam and in Korea; and (b) the travel and document agency.
