피고인들은 2016. 6. 30. 19:30경 부천시 소사구 C, 1층에 있는 D주점에서 주점주인 E 등 십여 명이 듣고 있는 가운데 무전취식 신고를 받고 출동한 F지구대 소속 경찰관 피해자 G에게 피고인 B은 큰소리로 “내가 아는 형사도 있으니 가라. 이 새끼야, 씨발놈아, 씨발새끼야” 등의 욕설을 하고, 피고인 A은 피해자를 향해 큰소리로 “이 씨발 경찰이면 다야, 왜 왔어, 개새끼야, 잔소리말고 꺼져 이 씹쌔끼야” 등의 욕설을 하여 공연히 피해자를 모욕하였다.
