A A The fines of fine of KRW 3,000,000, the fines of KRW 2,000,000, and the fines of KRW 1,500,00 shall apply to Defendant B, respectively.
Reasons
Punishment of the crime
Defendant
A is the 7th simultaneous local election of local council members who were sent to the E constituency of F political party, and the defendant B is the chief of the election office, and the defendant C is the former election office.
1. No one shall allow any minor under the age of 19 to engage in an election campaign.
Nevertheless, at around 15:00 on May 31, 2018, the Defendants conspired to conduct an election campaign for more than 30 minutes, such as having the H intersection, a minor person I (18 tax), J (18 tax), K (18 tax), and L (18 tax) wear clothes and decorations for election campaign at the site of the Defendant A’s oil site.
2. No one shall offer, express an intention to offer, or promise to offer money, goods, or other benefits in connection with the election campaign regardless of the pretext thereof, such as allowances, actual expenses, other compensation for volunteers, in contravention of the provisions of the Election of Public Officials Act, and compensation for actual expenses;
Nevertheless, at around 18:40 on May 31, 2018, Defendant B paid 200,000 won in cash to Defendant C at the election office of a candidate A located in G, and paid 20,000 won in total to all five persons, including minors and election clerks, who carried out an election campaign as referred to in the above paragraph (1). Defendant C, who received the above money from Defendant B, paid 130,000 won in total to Defendant B, who worked as a volunteer, and paid 20,000 won in return for an election campaign by paying 20,000 won in total to Defendant C, who worked as a volunteer.
Accordingly, the Defendants conspired to offer money or goods in relation to the election campaign.
3. The defendant A and C shall be eligible for allowances, actual expenses, and other compensation for volunteer service in violation of the provisions of the Public Official Election Act regarding persons related to election affairs provided for in the election campaign Act;
