피고인은 2020. 7. 7. 15:30경부터 같은 날 15:45경까지 피해자의 주거지인 위 아파트 E호 현관문 앞에서 피해자가 층간소음을 일으킨다는 이유로 그곳 현관문을 발로 수회 차고, 주먹으로 두드리며 피해자에게 "패 죽이뿔라 씨발년들이, 내 여기 사시미 칼로 씨발년들이 만나는 순간에 뒤지는지 알어 씨발 모가지를 꽉 따뿌까 마 씨발, 내 사시미 칼을 항상 준비해두니까 너는 만나는 순간 뒤지는 거여 씨발년들아, 문 열어라 씨발년아, 경찰 부르던가 좆 같은거 씨발, 경찰 부르는 순간에 씨발 내가 그냥 숨통 딱 끊어뿐다, 씨발년 아주, 내가 한 놈 죽이나 두 놈 죽이나 똑 같애 씨발년아, 내 하나 니 쥑이가 교도소 가서 병동에 편안하이 있는게, 씨발 여기서 밥 해 먹고 해 씨발년아, 어차피 막 나가는 거 너 하나 죽이는 거는 우스워 씨발년아, 문 열어라 씨발년아 좆 같은거, 보이는 순간에 콱 죽이뿐다, 나와라 죽여버릴테니까 칼 가와 함 쑤셔뿌까, 내 사시미 칼 가져 올꺼다, 문열어라 씨발년아, 좆 같은거, 씨발년이 어디 겁대가리 없이.“라고 말하면서 피해자를 협박하였다.
