그러자 안전에 위협을 느낀 H 택시의 운전기사가 2020. 5. 9. 00:20경 광주 서구에 있는 서구문화센터 버스정류장 앞 도로변에 택시를 정차하게 되었고, 피해자는 택시에서 내려 피고인에게 소리를 지르면서 욕을 했고, 이에 화가 난 피고인은 택시에서 내려 주먹으로 피해자의 얼굴 부위를 10여 회 때려 피해자를 바닥에 넘어뜨리고, 계속하여 주먹으로 피해자의 얼굴과 가슴 부위를 수십 회 때리고, 발로 넘어진 피해자의 온몸을 수회 찼다.
