A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

1. Violation of the Act on the Registration of Real Estate under Actual Titleholder’s Name;

A. On July 25, 2012, the Defendant: (a) was aware of the mutual influence at the office of the real estate in the Nowon-gu, Busan; and (b) had C enter into a sales contract for the E Apartment-gu, Geumpo-gu, Busan (hereinafter “this apartment”) with the name of Flux C, which was in his/her name, and (c) had C enter into the sales contract for the Fluxe-gu, Busan (hereinafter “Seoul apartment”).

On the same day, the defendant completed the registration of ownership transfer on the ground of sale under the name of the title trustee C at the Busan District Court's Geum-dong, Busan District Court's Geum-dong.

B. On July 31, 2012, the Defendant gave 600,000 won and borrowed the name in its name from F, which came to know through the Internet at the instant coffee shop located in Busan Shipping Daegu, under the name of the Defendant.

On the same day, the defendant completed the registration of ownership transfer for the apartment house under the name of the title trustee under the name of the title trustee.

2. Around July 31, 2012, the Defendant altered the official document, at a trade name incomprehive shop located in the 2-dong, Geumcheon-gu, Busan, to the apartment of this case issued by the head of the household, after misunderstanding the contents related to the G as stated in the column of the householder of the particulars of the transfer household inspection on the apartment of this case issued by the head of the Geum-gu, Busan.

Accordingly, for the purpose of uttering, the Defendant modified the content of perusal of the transferred household, which is an official document.

3. Around July 31, 2012, the Defendant: (a) had F, at the office of Taecheon-dong community credit cooperatives, located in the Dongcheon-dong-dong-dong-dong-dong-dong-gu, Busan, F, as stated in paragraph (2), deliver to H the employees in charge of lending the altered official document as if it were issued genuinely.

4. The criminal defendant, in fact at the time and place specified in Paragraph 3, is allowed to peruse the moving-in household altered as described in Paragraph 2, even though he/she resided in G in the apartment house with G.
