Punishment of the crime
【Defendant A sentenced ten months to imprisonment for a violation of the Act on the Control of Narcotics, etc. at Incheon District Court on February 4, 2016, and completed the execution of the sentence at a detention house on October 22, 2016.
【Criminal Facts】
1. Notwithstanding that Defendant A is not a person handling narcotics, Defendant A dealt with psychotropic drugs, psychotropic drugs, psychotropic drugs, such as the following:
The Defendant violated the Act on Special Cases Concerning the Prevention of Illegal Transactions in Narcotics (hereinafter referred to as the "comgram ID", and the "D"), on the Internet, advertised the sales of phiphones and sent pictures to many unspecified number of phiphone buyers who reported and contacted the phiphones to find the phiphones by sending pictures of the place where phiphones are hidden, or by directly sending the phiphones to the phiphones, and by receiving directly the phiphones from the buyer, he thought that the phiphones will sell phiphones by means of transfer of phiphones from the buyer without passbooks or receiving them directly.
On November 16, 2018, the Defendant sent a photo of optophone to the prosecution investigator who pretended to purchase optophones using telegram at an insular location at around 21:14, and had the above prosecution investigator find the optophone at around that time, and decided to conduct this transaction with the above prosecution investigator at around 21:38 on the same day. At around that time, the Defendant sold optophones by sending 400,000 won from the prosecution investigator through the first window of optophones and selling 0.4g of optophones.
The Defendant, either solely or in collusion with B, sold 136 instances, as described in the attached list of crimes (i) through (v) from May 10, 2018 to November 28, 2018, in total, sold 70 million won in the same manner.
