1. Defendant B indicated in the attached Form No. 4, 29, 30, 31, 32, 33, 34, 18, 19, 40, 40, out of 840 square meters in Cheongbuk-gun, Chungcheongnam-gun, Chungcheongnam-do.
Reasons
1. Determination as to the cause of claim
A. The following facts are recognized in full view of Gap evidence Nos. 2 and 5 (including paper numbers), the result of this court’s request for surveying and appraisal of the office of the Korea Cadastral Survey Corporation and the purport of the entire pleadings.
① On August 26, 2011, the Plaintiff acquired ownership of a F 370 square meters in Cheongbuk-gun, Chungcheongnam-gun, D major 840 square meters in size, E forest land 901 square meters in size, G orchard 1842 square meters in size.
② Defendant B, in turn, owns cement brick structure and sand position plate, located on the ground level of 123 square meters located on the part of 123 square meters in a ship (vii) and 119.08 square meters in a single roof, each of which is connected to the above F and D, in turn, in the order of 54, 55, 56, 56, 57, 58, 59, 60, 61, 62, 63, 64, 65, 66, 67, and 54 square meters.
③ Defendant B owned the said housing and connected each point of (b) section 617 square meters in the ship and (c) 18, 34, 36, 37, 38, 39, 40, 40, 34, 34, 18, 19, 40, 41, 42, 43, 44, 45, 7, 64, 65, 55, 55, and 4 of the attached Form (1), among the land and 50 square meters in the same housing site and 370 square meters in the same housing site, and the land and 50 square meters in the attached Form (1), and occupied and used a part of 259 square meters in the ship which connects each point of (b) 617 square meters in the same field, and (34, 35, 36, 37, 39, 40, 19, and 259 square meters in the ground.
④ 피고 C는 2011. 2.경 H로부터 위 G 중 별지(2) 도면 표시 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 1의 각 점을 차례로 연결한 선내 (ㅈ)부분 605㎡에 식재된 소나무, 같은 도면 표시 4, 25, 26, 27, 4의 각 점을 차례로 연결한 선내 (ㅊ)부분 110㎡에 설치된 하우스 철골구조물, 같은 도면 표시 28, 29, 30, 31, 28의 각 점을 차례로 연결한 선내 (ㅋ)부분 4㎡에 설치된 판넬창고, 같은 도면 표시 32, 33, 34, 35, 36, 37, 32의 각 점을 차례로 연결한 선내 (ㅌ)부분 87㎡에 설치된 비닐하우스, 같은 도면 표시 11, 12, 13, 14, 15, 11의 각 점을 차례로 연결한 선내 (ㅍ)부분 1㎡에 설치된 이동식 화장실에 관한 처분권을 양도받아 이를 관리하고 있다.
