A defendant shall be punished by imprisonment for not less than one year and six months.
The defendant shall be liable to the applicant B for the damage KRW 120,000, and the compensation.
Reasons
Punishment of the crime
【The Defendant was sentenced to six months of imprisonment for fraud at the Jeonju District Court on August 13, 2018, and completed the execution of each of the above punishment in the Jeonju Prison on August 19, 2019.
【Criminal facts】 On March 28, 2020, the Defendant: (a) visited the Defendant’s home located in the Gunsan-si, Sinsan-si, and posted a letter as if he sold the said game machine; and (b) sold the said game machine to 160,000 won to 1.60,000 won.
A false statement was made.
However, the defendant merely tried to raise personal funds to use for debt repayment, gambling, etc. by pretending the sale of goods, and there was no intention or ability to deliver the goods to the victim as agreed.
Nevertheless, the Defendant, as seen above, received KRW 160,00 from the victim to the R bank account (S) in the name of the Defendant, as well as from October 16, 2020, the Defendant acquired 4,129,000 won in total on 29 occasions, such as the list of crimes, from around October 16, 2020.
The Defendant, on April 10, 2020, up to 2020, up to 1808, posted a letter as if he had access to the P Q website, posted it as if he had sold it, and sold KIKO to 80,000 won for the victim who had contacted with the Defendant.
A false statement was made.
However, in fact, the defendant was trying to secure personal funds to use for debt repayment, gambling, etc. by pretending to sell goods, and did not have the intent or ability to deliver the goods to the victim as agreed.
Nevertheless, on April 12, 2020, the Defendant: (a) by deceiving the victim as above; (b) received KRW 80,000 from the Defendant’s U.S. bank account (V) around April 12, 202 from the victim; and (c) received a total of KRW 490,000 from the victims via the above two methods, such as the list of crimes, from around that time to May 24, 2020.
