Reasons
Punishment of the crime
1. Defendant A
(a) No person, other than a marina society, shall provide property or financial benefits to persons who engage in any conduct similar to the riding voting in connection with racing conducted by a marina society;
Nevertheless, around January 6, 2012, the Defendant, in collusion with the unclaimed winners selling private horse tickets in Seoul, sold a private horse ticket in an amount equivalent to two million won to B while viewing the horse racing program installed at his own office located in Gwangju-gu, Seo-gu, Gwangju-gu, through the Internet, and provided a similar act by selling the horse riding ticket to B, which is equivalent to the dividend rate paid in a marina society, if the horse riding was loaded, and the Defendant paid dividends at the same rate as the dividend rate paid in a marina society and did not cover the horse riding, and the Defendant acquired the entire money from September 16, 201 to April 6, 2012 from around September 16, 201 to around April 6, 2012, as described in paragraphs (1), (2), (3), and (4) of the attached list of crimes.
B. From July 10, 201 to June 29, 2012, the Defendant used a horse for gambling using a horse racing: (a) purchased a private horse ticket equivalent to KRW 600,210,000 in total over 80 times, as shown in the list of crimes in attached Table (5) from around July 10, 201 to around June 29, 201; and (b) used a horse for gambling conducted by a marina Society by receiving a timely dividend payment.
2. Around January 6, 2012, Defendant B: (a) viewed a horse broadcasting program installed at the Internet located in the said office located in Gwangju-gu, Gwangju-gu; (b) purchased a private horse ticket equivalent to KRW 2 million from the said A from that time until February 26, 2012; (c) purchased a private horse ticket equivalent to KRW 8,7550,000 in total on 21 occasions, as indicated in the list of crimes (1) of the attached Table, and stuffed by a marina Society by purchasing a private horse ticket of KRW 87,550,00 from that time.
