A Imprisonment for eight months, Defendant B’s imprisonment for four months, Defendant C’s fine for 2,500,000 won, and Defendant D’s fine for three months.
Reasons
Punishment of the crime
1. A person who is not the single criminal racing of Defendant A shall not commit any act similar to the horse riding voting, in connection with the racing conducted by the marina society, to allow the enemy to commit any act of paying goods or financial gains;
Nevertheless, the above defendant recruited the buyers of the private horse tickets, received a request from them to sell the private horse tickets, delivered them to the general account book and the fund accounting book for the management of the funds (hereinafter referred to as the "Center"), or bought the horse tickets to serve as an intermediary for the settlement of the dividends according to the results of the racing conducted by the Korean Racing Association (hereinafter referred to as the "coling").
According to the aforementioned plan, the above Defendant: (a) from November 8, 201, viewed the horse racing program at an unclaimed place, and (b) took 100,000 won for each horse racing held by the Korean Racing Association to customers who want to purchase the horse racing tickets, and (c) returned 15% of the horse tickets to customers under the name of a car, “purchase”; (d) sold the horse ticket under the name of money if the relevant race race is not pre-paid; and (e) transferred the horse ticket and the sales proceeds to the center under the name of the money; and (e) performed similar horse racing by receiving 1 to 2% of the horse ticket from the Center in the form of a fee.
Accordingly, the Defendant received or received a private horse ticket equivalent to KRW 6,379,700,773 from November 8, 201 to November 8, 2012, as indicated in the attached Table I, as the purchase price of the horse ticket. According to the racing’s result, if a customer is valuable in the horse, the Defendant had the passenger engage in an act similar to the horse racing voting by receiving the price from the last center and paying it to the customer.
