The prosecution of this case is dismissed.
Reasons
1. The Defendant in the facts charged is the chief of the management department of the redevelopment and improvement project of the Jeju-gu D Housing Redevelopment, and the complainant is the chairman of the said D E Committee.
A. On January 22, 2016, the Defendant of defamation: (a) at the Gwangju-dong, Gwangju-gu, Gwangju-gu, the Committee did not receive funds from the subcontractor of the redevelopment workplace; (b) provided information that “The funds to be used by the E members are being provided by the subcontractor with subsidies from the subcontractor of the redevelopment workplace of North-gu,” despite the fact that the Committee did not receive funds from the subcontractor of the redevelopment workplace of North-gu, and (c) provided information that the funds to be used by the E members were being provided by the subcontractor; (d) if the association was in bad condition, the Mo-gu may reverse all contracts and change the procedures for the repair and maintenance company, but may be able to fully repay the funds used by the subcontractor.
The letter "A4 paper of the quantity of a set of "A4" was sent to 376 members by mail, thereby impairing the honor of the E Committee by openly pointing out false facts.
(b) No person who violates the Act on Promotion of Use of Information and Communications Network and Information Protection, etc. shall defame another person by openly pointing false facts through an information and communications network with intent to defame a person;
Nevertheless, the Defendant, at around 12:05 on January 22, 2016, sent to 376 members of the E Committee a false letter of “The E Committee shall receive 200 million won funds from the rearrangement business entity in the redevelopment area and spread wills and remove the president of the E Committee,” with the aim of slandering the E Committee by accessing the G site at around 12:05, Gwangju Dong-gu, 2016. On January 22, 2016, the Defendant sent to 376 members of the E Committee, and continuously, on January 24, 2016, with a view to slandering the E Committee by accessing the said G site, it is necessary to transparently indicate the total amount of KRW 400 million and the source of money currently being paid.
