Reasons
Punishment of the crime
The defendant's attachment B died on March 9, 2019.
1. Crimes committed on March 12, 2019:20;
A. At around 11:20 on March 12, 2019, the Defendant: (a) stated “B” in the name column, “1,400,000 won” in the amount column by using a typesetting pen in the DDR’s monetary list at the seat of Gangwon-si, Gangwon-si; and (b) affixed the seal of B in advance on his name.
Accordingly, for the purpose of uttering, the Defendant forged a letter of money check in B, a private document on rights and obligations.
B. The Defendant’s uttering of the above investigation document and the fraud above A.
At the same time and place as referred to in Paragraph B, the above forged monetary statement was submitted as if it was duly formed to an employee under the name in question, and was exercised by him as if he had legitimate authority to withdraw a deposit from his account in his name or to transfer the account, and deceiving the staff of the D association in his name by deceiving him as if he had legitimate authority to do so, the said staff shall withdraw 1.4 million won in cash from his account in his name, and shall have the said staff withdraw 1.4 million won in cash from his account in his name, and remitted 10 million won in his account in his name to E, thereby obtaining the said KRW 1.4 million.
2. Crimes committed on March 12, 2019:30
A. At around 13:30 on March 12, 2019, the Defendant: (a) stated “B” in the name column and “72,378,000 won” in the amount column, and affixed B’s seal in advance on the name, for the purpose of uttering at the same place as Paragraph (1).
Accordingly, for the purpose of uttering, the Defendant forged a letter of money check in B, a private document on rights and obligations.
B. The uttering of the above investigation document and the fraud of the Defendant are above B.
At the same time and place as in paragraph (1), it is true that the above forged monetary statement has been made to an employee under the name of the person who is not aware of the fact.
