A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On May 24, 2011, the Defendant was sentenced to a suspended sentence of one year and six months for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes in the Daegu District Court, which became final and conclusive on June 1, 201.

1. Crimes committed on August 10, 2010;

A. On August 10, 2010, the Defendant: (a) stated, “Account Number: B; (b) gold million won (Won 8,000,000); (c) August 10, 2010; and (d) sealed C’s seal in advance on his/her name, on the paper of the monetary sheet kept there.

For the purpose of exercising these rights, the Defendant, without authority, forged a copy of the withdrawn monetary statement, which is a private document on the rights and obligations under C’s name.

B. The use of the above investigation document, the fraud defendant, at the above date, at the above time and place, submitted a false monetary check in the name of C to the employees of the counter to the name-dissipated, and also presented C's post office account passbook in advance.

As such, the Defendant, as if the said statement of money was duly made out, had a counter staff deceiving him, and received KRW 8 million from the same Daegu post office for the withdrawal of deposits from the victim.

2. The crime committed on August 12, 2010;

A. On August 12, 2010, the Defendant forged private documents stated “Account Number: B, gold million won (Won 1,000,000), August 12, 2010, and C’s seal in advance was affixed on the printed money sheet in the Daegu-dong Post Office, Daegu-gu, Daegu-gu, 2010, using a non-written tool on the printed money sheet.”

For the purpose of exercising these rights, the Defendant, without authority, forged a copy of the withdrawn monetary statement, which is a private document on the rights and obligations under C’s name.

B. The Defendant, at the above time and place, shall submit and exercise a false statement of money in the name-free counter staff under the above name C, who is aware of the forgery.
