A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

1. A crime on January 26, 2010;

A. On January 26, 2010, the Defendant forged private documents: (a) agreed to develop a web program and received KRW 500,000,000 under the pretext of the start money from the Defendant’s vehicle parked in front of the implied elementary school at the Seocho-gu Seoul Metropolitan Government, the Defendant entered “D” and signed “D” on the paper A4, stating “Won 5,000,000,000,000.”

Accordingly, for the purpose of uttering, the Defendant forged a copy of deposit certificate in the name of D, a private document related to rights and obligations.

B. The Defendant: (a) delivered a forged deposit certificate to C, who was aware of the forgery at the above time and place; and (b) exercised it as if it were duly formed.

2. A crime on August 16, 2010;

A. On August 16, 2010, the Defendant received KRW 3,650,00 from C in the name of expenses related to the development of the web program in accordance with the contract concluded as stipulated in paragraph (1) at a place where it is not known at around August 16, 2010, and signed the “E” on the blank, which was divided by half of the paper A4, using an official approval color pen, stating that the above amount is paid in full, and signed on the blank as “E” next.

Accordingly, for the purpose of uttering, the Defendant prepared a receipt in the name of E, which is a private document on rights and obligations.

B. The Defendant: (a) issued a forged receipt to C who is aware of the forgery at the above time and place; and (b) exercised it as if it was duly formed.

3. Crimes on August 18, 2010

A. On August 18, 2010, the Defendant: (a) received KRW 13,00,000 from C in the name of the cost associated with the development of the web program in accordance with a contract concluded in a place where it is not known around August 18, 2010; and (b) divided the paper A4 by half of the pages, using a black pen.
