Defendant

A shall be punished by imprisonment with prison labor for ten months, and imprisonment with prison labor for six months.

1. Defendant A

가. 공무집행방해 피고인은 2014. 6. 17. 23:37경 의정부시 C 지하1층 "D노래장"에서 술값을 내지 않는다는 112신고를 접수하고 현장에 도착한 E지구대 소속 경찰관 경사 F와 순경 G을 보고 '짭새 새끼 왔네'라고 하면서 갑자기 주먹으로 G의 가슴을 2회 때리고, 위 노래장 업주가 요금이 다 계산되었다고 하여 F 등이 현장에서 철수하려 하자 “이 짭새 새끼들아 어딜가 이 새끼들아"라고 욕설을 하여 F가 피고인에게 욕설을 하지 말라고 하자 F의 목을 주먹으로 1회 때리고 머리를 손으로 쳐 모자가 떨어지게 하는 등 폭행하였다.

Accordingly, the defendant interfered with the legitimate execution of duties concerning the dispatch of 112 reported police officers.

나. 모욕 피고인은 위 일시, 장소에서 위 노래장 종업원 H 등이 듣고 있는 가운데 피해자 F에게 "야 이새끼야 내가 신고했는데 어디가냐, 이 개새끼야 왜 그냥 도망가냐 씹새끼야, 야 짭새새끼야 I이나 잡아라, 병신새끼들"이라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
