A defendant shall be punished by imprisonment for a term of one year and ten months.

Seized evidence 1, 4, 5, or 6 shall be confiscated.

The defendant 13,229.

Punishment of the crime

On April 1, 2015, the Defendant was sentenced to ten months of imprisonment for a violation of the Act on the Control of Narcotics, Etc. at the Ulsan District Court on April 1, 2015, and completed the execution of the sentence at the Ulsan Detention Center on November 26, 2015.

Despite the fact that the Defendant is not a person handling narcotics, the Defendant dealt with the psychotropic drugs-related Mesofts (i.e., one philopon; hereinafter referred to as “philopon”), as follows:

1. The Defendant: (a) purchased approximately KRW 10,100,000 from B to purchase KRW 2.1 million; (b) transferred KRW 1,40,000,000 out of KRW 2,100,000 from B to B’s account on August 1, 2018; and (c) purchased approximately 10,000,000,000 won of the remainder of opon from B to B at the parking lot in Taecheon-si, Gangwon-do.

In addition, the Defendant purchased approximately KRW 50,500,00 from B, etc. seven times in total from the above date to August 18, 2019, as shown in Appendix 1.

2. On August 1, 2018, the Defendant: (a) decided to sell phiphones to D; (b) received KRW 2.1 million from D to E’s account used by the Defendant; (c) sold 10g of phiphones to D in the C parking lot as set out in paragraph (1) of the said paragraph; and (d) sold approximately 10g of phiphones to D in 2.1 million won.

In addition, from the above date to June 21, 2019, the Defendant sold approximately KRW 55 gramphones to D in total eight times, as shown in attached Table 2 of Crimes List 2.

3. Medication of phiphones.

A. On July 10, 2019, the Defendant decided to administer phiphones together with D, put approximately 0.1g of each phiphones into two phiphones in the car parked in the G parking lot located in the Gongn-nam-si, Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si on July 10, 2019, and dilution them with water, and the Defendant voluntarily injected into his arms blood cells, and D phiphones in collusion with D by means of injection by the Defendant.
