Basic Facts

The Plaintiff’s status is a company established on December 2, 1996 with the business of operating a hotel business as its objective business, and on July 12, 2005, the Plaintiff operates a tourist hotel (hereinafter “instant hotel”) with the trade name “bictoria hotel” in six parcels of total 6 parcels from the 14, 89-1, 89-1, 32-3, 13-1, 13-5, and 13-6.

On June 27, 2012, the Do Governor of Jeonnam-do changed the special-purpose area of 10,754 square meters in 100,000,000,000,000,000, to the management plan area, and newly established a youth training center as an urban planning facility (juvenile training facility) (hereinafter “the determination of the instant urban planning facility”), and publicly announced the determination of the urban planning facility as prescribed in Article 2012-209 of the Do Governor of Jeonnam-do.

On December 26, 2012, the Defendant, who has the Defendant’s implementation plan, designated the Office of Education in Gwangju Metropolitan City as the project implementer of an urban planning facility project (hereinafter “instant project”) according to the determination of the instant urban planning facility project (hereinafter “instant project”), and authorized the division implementation plan on the instant project with the following contents (hereinafter “instant disposition”). The Defendant publicly announced it as prescribed in Article 2012-69.
