A defendant shall be punished by imprisonment with prison labor for not more than ten months.

Punishment of the crime

"2019 Highest 2856"

1. On June 12, 2018, the Defendant violated the Special Act on Insurance Fraud Prevention: (a) around 14:20, the Defendant: (b) reported the Eone Star Car of D Driving, which was running in front of and outside the city of Busan, at the same location B, to the effect that the said D’s negligence caused a traffic accident; (c) requested insurance management; (d) received insurance payment from the victim to the G bank account (H) in the name of the Defendant on the same day; and (d) received KRW 300,000 from the victim to October 14, 2019, the Defendant received KRW 16,30,300 by aggregating 34 times in total, as shown in the attached Table of Crimes (1) from the victims to October 14, 2019, and received KRW 16,30,940,940 from the victims in the same manner as the victim’s G bank account (H).

2. On June 4, 2019, around 18:35, 2019, the Defendant: (a) reported the victim’s K Poter Cargo Vehicles at the end of the Seo-gu Busan International Market and caused the traffic accident by the victim’s negligence; and (b) received 800,000 won from the victim to the L Bank Account (M) in the name of the Defendant on the same day from June 25, 2019; and (c) received KRW 950,000,000 from the victims by the same method twice in total as indicated in the attached list of crimes (2) from June 25, 2019.

3. On November 25, 2018, the Defendant attempted to commit fraud: (a) reported a P taxi operated by a victim’s P taxi that was frighting in front of the Seo-gu, Busan, Seo-gu; and (b) when the said taxi passes through his/her own seat, the Defendant intentionally fright his/her arms against the victim’s negligence; and (c) demanded insurance management; (d) however, the Defendant’s act constitutes insurance fraud.
