1. Defendant D is the Plaintiff:
A. Of the 321m2 in Busan Seo-gu, the number of pages 8, 20, 6, 7, and 8 are indicated in the annexed drawings.
Reasons
1. Facts of recognition;
A. The Plaintiff is an owner of FJ 321 square meters in Busan Seo-gu (hereinafter “instant land”).
B. Defendant C and Nonparty G shared the instant building with H, I, and J ground (hereinafter “instant building”) located in Busan Seo-gu. A part of the instant building is adjacent to the instant land.
C. On November 14, 2012, Defendant C agreed to lease part of the first floor of the instant building to Defendant D, and Defendant D, from around that time, runs the sales business of the instant building with the trade name “K” in the part adjacent to the instant land among the first floor of the instant building (hereinafter “instant store”).
Defendant D, in sequence with each point indicated in the attached Form 8, 20, 6, 7, and 8 among the land in the instant case, installed the air conditioners (hereinafter “instant air conditioners”) and the attached Form 10, 15, 9, and 10 attached Form 10, 19, 4, 5, 6, 20, 8, and 9 attached Form 9, 19, 4, 6, 20, 8, and 9 are occupying and using the air conditioners and coordinates on the ground of the part caused by the instant air conditioners, which connected each point in the order of the two points.
