A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 22, 2016, the Defendant stated that, at the Defendant’s home located in Eunpyeong-gu Seoul Metropolitan Government B and 502, the Defendant sent KRW 192,000 to the Defendant C through the online game “the wind country”, the Defendant would bring KRW 200 million to the Defendant’s home.

However, even if the defendant receives the money from the victim, he did not have any intention or ability to sell it.

As above, the Defendant, by deceiving the victim as above, received KRW 192,00 from the victim to the company bank account (D) in the name of the defendant on the same day, and acquired it as the price for the game money, and acquired it by deceiving it, and also received KRW 1,759,000 in total eight times from that time to May 11, 2016 through the same method, as shown in attached Table 1.

On March 21, 2016, the Defendant, at the Defendant’s house located in Eunpyeong-gu Seoul Metropolitan Government B and 502, posted a sales letter to the Defendant’s home, and “I will sell memberships for the Liber Annual Memberships” and reported the sales letter to the victims E who contacted with the Defendant.

However, in fact, the defendant did not have any intention or ability to sell the price even if he received the price from the victim because he did not have the above membership.

Ultimately, the Defendant, as above, by deceiving the victim as above, received 360,000 won in the name of membership from the victim to the Agricultural Cooperative (F) account in the name of the Defendant on the same day, and acquired 562,500 won in total on four occasions from that time to April 7, 2016 through the same method as shown in the attached crime list 2.

The Defendant, on April 6, 2016, written a statement that “The Victim G wishes to purchase one’s own social stack admission tickets” on the Internet NAV bulletin board, at a non-place on April 6, 2016.
