Criminal facts
1. From March 30, 2019, around the second floor of C Hospital in Michuhol-gu Incheon Metropolitan City on March 30, 2019, the Defendant stolen, in front of the second floor of C Hospital in Michuhol-gu, Incheon, the Defendant 30,000 won in cash, the victim’s possession, and the KB CBC card (E) in the victim’s name, etc., brought about theft.
2. Fraud, fraud, or violation of the Specialized Credit Finance Business Act;
A. On March 30, 2019, around 09:19, the Defendant presented the KBC card in the name of the victim, as described in paragraph (1), to the taxi article in his/her name, as if he/she was his/her card, and had the victim settle KRW 6,000 in the name of the taxi fee.
B. On March 30, 2019, at around 10:32, the Defendant purchased the 111th floor of the building G building in Nam-gu Incheon Metropolitan City (H), and presented the KBC card in the name of stolen-friendly DNA to the operator of a store as if he was his card, and presented it to the operator of the store in the name of the victim as if he was his card, and had the victim settle 229,000 won as the price for the goods. However, the Defendant refused approval by a report of theft of a card, and failed to perform such intent.
C. On March 30, 2019, around 10:41, the Defendant: (a) purchased a sports at the first floor new store of the building in Nam-gu, Incheon Metropolitan City; (b) presented the KBC card in the name-free shop operator in the name of the victim as if he/she was his/her card; and (c) presented it to the operator of the store in the name-free shop in the name of the victim as if he/she was one of his/her card; (d) however, the Defendant did not refuse approval due to the theft of the card and did not commit an attempted act.
On March 30, 2019, around 10:45, the Defendant purchased tobacco A from the “I” convenience store in front of the building in Nam-gu Incheon Metropolitan City, and presented the KBC card in the name-free store operator of the victim as if he was his card, as described in paragraph 1.
