피고인은 2013. 11. 26.경 고양시 일산동구 B에 있는 피고인의 집에서 인터넷 C의 D게시판에 성명불상자가 ‘누가 비구니 건드렸냐.’라는 제목으로 E이 피해자 F의 트위터에 피해자가 처녀막이 있는지 궁금하다는 글을 게시하자, 피해자가 E이 다니는 대학 총장에게 학생 지도를 잘하라는 내용의 댓글을 게시하였다는 내용의 머니투데이 기사를 옮겨와 게시하자, 위 글의 댓글 란에 “대통령한테도 하던 드립인데, 저 비구니 년 좌빨 실천승가횐지 먼지 하면 그거 패러디 한거라고 우겨라.“라는 내용의 댓글을 게시하여 공연히 피해자를 모욕하였다.
