나. 소외인이 D 인터넷 일간베스트저장소 사이트(www.ilbe.com, 이하 ‘이 사건 인터넷사이트’라 한다.)의 게시판에 “E”라는 제목으로 F이 원고의 트위터에 원고가 처녀막 있는지 궁금하다는 글을 게시하여 F이 사과하고 원고가 용서해준 경위 등을 설명하는 글을 게시하자, 피고 C은 같은 날 “G”이라는 대화명으로 “저렇게 종교웅딩이에 숨어서 권이 이용하는 새키들이야말로 찢어죽여야 한다.”, “즈른놈들이 할말 다하고 살면서 남들이 하는말엔 좆같다고 ㅈㄹ염병을 뜨는거盧” 라는 내용의 댓글을 작성하여 게시하였다.

다. 소외인이 H경 일베저장소의 I 게시판에 “J”라는 제목으로 원고의 트위터 글과 건외 F의 트위터 글을 캡쳐하여 게시하면서 원고에 대한 욕설을 게시하자 피고 B는 같은 날 위 글에 “K”라는 닉네임을 사용하여 “어~따 글 한번 걸죽하게 잘 썼노..A인가 하는 땡중 비구니가 정신이 반쯤이라도 돌아오면 삼배하고 배움을 청해야겠구만. 근데 쟈는 꼬라지가 평생 정신 돌아오기는 틀렸다. 오히려 은신처로 절을 택한 것 아닌가 의심해봐야 할 자다.”라는 내용의 댓글을 게시하였다.
