A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

A person who intends to employ a seafarer, a person engaged in job placement, recruitment, employment, and management of seafarers, or any other person engaged in labor and personnel management business of seafarers shall not receive money and other valuables or other benefits from a seafarer under any pretext or a person who intends to be a seafarer in relation to such job placement, recruitment, employment, etc.

그럼에도 피고인은 2017. 10. 15. 10:00 경 제주시 소재 제주 항 4 부두 동 초소 앞에서 우연히 알게 된 유자망 어선인 C(29 톤, FRP) 의 선주 D 가 선원을 필요로 한다는 사실을 알고 제주에 있는 중국인들을 상대로 SNS 인 위챗과 QQ 대화방에 선원을 구한다는 광고를 한 뒤 2017. 10. 17. 16:00 경 제주시 E 소재 선원 숙소에서 위와 같은 광고를 통해 알게 된, 무사 증으로 입국한 중국인 ‘F’ 을 D에게 선원으로 소개시켜 주고 ‘F ’으로부터 소개비 명목으로 30만 원을 받고, 2017. 11. 2. 경 선원이 필요 하다는 D의 연락을 받고, 2017. 11. 4. 16:00 경 위 E 소재 숙소에서 위와 같은 광고를 통해 알게 된, 무사 증으로 입국한 중국인 ‘G’ 과 ‘H ’를 D에게 선원으로 소개시켜 주고 위 중국인들 로부터 소개비 명목으로 1 인 당 30만 원씩을 받았다.
